1. Introduction

Big Trades Pty Ltd (ACN 675 463 797) (“Big Trades”, “we”, “our”, “us”) operates a networking and jobs platform for tradespeople and businesses in Australia, accessible via our website, mobile app, and web app (collectively, the “Platform”).

This Privacy Policy explains how we collect, hold, use, and disclose your personal information, and how you can access, correct, or request deletion of that information. It applies in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. By accessing or registering on the Platform, you accept this Privacy Policy.

2. Information We Collect

We collect personal information that you provide when registering an account, creating a Tradesperson or Business Profile, posting or applying for a Job Listing, making a payment, messaging other users, posting reviews, or contacting us. This may include your name, email address, phone number, date of birth, trade qualifications, licences, work history, ABN, profile photo, and payment details.

We also collect technical and usage information automatically when you use the Platform, such as your IP address, device type, browser, pages viewed, and location data where you have enabled location services. We use cookies and similar technologies for this purpose.

We may also receive information about you from third-party providers such as payment processors, analytics providers, and verification services. You should not include sensitive information (such as health information or criminal record information) in your profile or communications. If you do so, you do so voluntarily and at your own risk.

3. How We Use Your Information

We use your personal information to:

• Operate and maintain the Platform, including managing your account and profiles;

• Facilitate job applications and connect Tradesperson Profile holders with Business Profile holders;

• Process payments for Job Listings and other paid features;

• Send you transactional notifications about your account and activity on the Platform;

• Improve the Platform through analytics, research, and development;

• Send you marketing communications where you have consented, which you can opt out of at any time; and

• Comply with our legal obligations and enforce our User Agreement.

4. When We Share Your Information

We do not sell your personal information. We may share it in the following circumstances:

• With other users: Your profile is visible to other Platform users. When you submit an on-platform job application, your profile is shared with the relevant employer.

• With service providers: We share information with third-party providers who help us operate the Platform (such as hosting, payments, analytics, and customer support). They are contractually obligated to handle your information only for the purposes for which it is shared. Big Trades is not liable for the acts or omissions of service providers beyond those contractual obligations.

• For legal reasons: We may disclose your information where required or authorised by law, including in response to a court order or law enforcement request. We are not obliged to notify you of such disclosures.

• On a business transfer: If Big Trades is sold or restructured, your information may be transferred to the relevant acquirer. We will use reasonable endeavours to notify you, but accept no liability if notification is not practicable.

The Platform may also direct you to third-party websites or email addresses to complete a job application. Big Trades is not responsible for the privacy practices of any third party, and this Privacy Policy applies only to information collected by Big Trades through the Platform.

5. Overseas Disclosure

Some of our service providers store or process data outside Australia. Where your personal information is disclosed to overseas recipients, we take reasonable steps to ensure it is handled consistently with the Australian Privacy Principles, including through data processing agreements or reliance on our reasonable belief that the recipient is subject to a substantially similar privacy law or scheme.

By using the Platform, you consent to such overseas disclosures. To the extent permitted by law, you agree that APP 8.1 does not apply and that Big Trades will not be accountable for the subsequent handling of your information by an overseas recipient.

6. Security

We use industry-standard technical and organisational measures to protect your personal information from misuse, loss, unauthorised access, modification, or disclosure. No method of transmission or storage is completely secure. To the fullest extent permitted by law, Big Trades does not accept liability for unauthorised access to or loss of your personal information where we have taken reasonable steps to prevent it. We will notify the OAIC and affected individuals of any eligible data breach in accordance with the Notifiable Data Breaches scheme.

7. Data Retention

We retain your User Data for as long as necessary to fulfill the purposes outlined in this Policy, or as required by law. If you close your account or delete your profile, we will retain your data for a period necessary to comply with legal obligations, resolve disputes, and enforce our agreements.

8. Your Rights

You have the right to request access to, correction of, or deletion of the personal information we hold about you. Most profile information can be updated directly through your settings. 

You can opt out of marketing communications at any time via the unsubscribe link in any marketing email.

9. Changes to This Policy

We may update this Policy from time to time. Any changes will be communicated through the Platform or via email. The updated Policy will be effective as of the date posted, and your continued use of the Platform will constitute acceptance of those changes.
